Welcome to Houseticker. These Terms of Use (“Terms”) govern your access to and use of houseticker.com and any related websites, features, emails, alerts, reports, applications, and services we provide (collectively, the “Service”).

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. About Houseticker

Houseticker helps users monitor and understand local housing markets. The Service may provide information about listings, sales, price changes, pending transactions, market activity, historical observations, school-district-based market segments, comparable properties, statistics, trends, and automated or editorial analysis.

Houseticker is an independent information and analytics service.

Houseticker is not a real estate brokerage, real estate agent, multiple listing service (“MLS”), appraiser, lender, financial adviser, investment adviser, attorney, school district, or governmental agency.

2. Informational Purposes Only

All information provided through Houseticker is for general informational and research purposes only.

Nothing on Houseticker constitutes:

You are responsible for conducting your own due diligence and consulting appropriate professionals before making real estate, financial, legal, educational, or other significant decisions.

3. Housing and Listing Data

Houseticker obtains listing, sale, property, market, geographic, and related information from third-party sources and publicly available information.

Third-party data may be delayed, incomplete, incorrect, duplicated, subsequently revised, or unavailable. A property's actual status may differ from the status displayed on Houseticker.

Houseticker may also preserve information that we previously observed, such as an earlier asking price or listing status. References to an “original ask,” listing history, price change, relisting, or similar event describe information observed by Houseticker and do not necessarily represent a complete history from every possible source.

We do not guarantee the accuracy, completeness, timeliness, availability, or continued availability of any listing or property data.

Users should verify important property information independently.

4. Market Statistics and Analysis

Houseticker may calculate statistics such as median prices, price per square foot, days on market, listing activity, pending activity, year-over-year changes, comparable-home ranges, and other measurements.

These results depend on the properties included, the applicable time period, available data, and Houseticker's methodology.

Small sample sizes, changes in the mix of homes sold, unusual properties, data errors, market volatility, and other factors may materially affect the results.

Houseticker may also identify trends, unusual activity, relationships, comparisons, or other observations using software, statistical methods, and artificial intelligence. Such analysis represents an interpretation of available data, not a statement of fact about future market performance or the motivations of buyers, sellers, agents, or other parties.

Past market behavior is not a guarantee of future results.

5. School Districts and Geographic Boundaries

Houseticker may organize housing markets using school districts, attendance areas, cities, geographic boundaries, property characteristics, or combinations of these factors.

School-district and school-attendance boundaries may change and may contain errors or ambiguities in third-party or published data.

A property's appearance within a Houseticker market does not guarantee enrollment eligibility, school assignment, transfer eligibility, or attendance rights.

Users should confirm school assignments and boundaries directly with the applicable school district before making a housing decision.

6. Accounts

Some features may require an account.

You agree to provide accurate information and to keep your account credentials secure. You are responsible for activity conducted through your account unless caused by Houseticker's own failure to maintain reasonable security.

You may not impersonate another person, create accounts using misleading information, or use another person's account without permission.

We may limit, suspend, or terminate accounts that violate these Terms or create security, legal, operational, or abuse risks.

7. Acceptable Use

You may use Houseticker for lawful personal or internal business purposes consistent with these Terms.

Unless we provide written permission, you may not:

Normal use of the website through a standard browser is permitted.

8. Intellectual Property

The Service, including its design, software, interfaces, branding, written analysis, graphics, market definitions, organization, selection and arrangement of information, and original content, is owned by or licensed to Houseticker and is protected by applicable intellectual-property laws.

Individual facts, public records, and third-party information may belong to their respective owners or may not independently be subject to intellectual-property protection. These Terms do not claim ownership over material that Houseticker does not own.

Subject to these Terms, Houseticker grants you a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purposes.

“Houseticker,” its logos, and related branding may not be used in a way that implies endorsement or affiliation without permission.

9. Third-Party Services and Content

The Service may incorporate or link to information, websites, maps, authentication providers, payment processors, analytics providers, listing-data providers, or other services operated by third parties.

We do not control those third parties and are not responsible for their content, availability, privacy practices, accuracy, or actions.

Your use of third-party services may be governed by separate terms and privacy policies.

10. Beta Features

Houseticker may designate some or all of the Service as beta, experimental, preview, or otherwise under development.

Beta functionality may change substantially, contain errors, become unavailable, or be discontinued without notice.

We may add, remove, modify, or reorganize markets, features, methodologies, metrics, and data sources as the Service develops.

11. Paid Services

Houseticker may offer paid subscriptions or other paid features in the future.

If you purchase a paid service, the applicable price, billing frequency, included features, renewal terms, and cancellation terms will be disclosed before purchase.

Unless otherwise stated at checkout, recurring subscriptions will continue until canceled.

Taxes may be added where required by law.

Additional terms displayed at the time of purchase will become part of these Terms.

12. Communications

If you request alerts, reports, market updates, or other communications, we may send them using the contact information associated with your account.

You may unsubscribe from marketing communications using the unsubscribe mechanism provided in those messages. Certain transactional or service-related communications may still be necessary to operate your account.

13. Feedback

If you provide ideas, suggestions, feedback, or recommendations regarding Houseticker, you give us permission to use them without restriction or compensation to you.

This does not give us ownership of personal information contained in your communications.

14. Availability and Changes to the Service

We may modify, suspend, restrict, or discontinue all or part of the Service at any time.

We do not guarantee that Houseticker will always be available, uninterrupted, secure, or free from errors.

We may correct errors or revise previously published information at any time.

15. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

HOUSETICKER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AND RELIABILITY.

WE DO NOT WARRANT THAT DATA, ANALYSIS, PROPERTY INFORMATION, SCHOOL INFORMATION, MARKET STATISTICS, OR OTHER CONTENT WILL BE ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR ANY PARTICULAR DECISION.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOUSETICKER AND ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST OPPORTUNITIES, OR LOSSES ARISING FROM A REAL ESTATE OR FINANCIAL DECISION MADE USING THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOUSETICKER'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

  1. THE AMOUNT YOU PAID TO HOUSETICKER DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
  2. $100.

Some jurisdictions do not permit certain limitations of liability, so portions of this section may not apply to you.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Houseticker and its affiliates, officers, employees, and contractors from claims, liabilities, damages, and reasonable expenses arising from your unlawful use of the Service, your material violation of these Terms, or your infringement of another person's rights.

18. Termination

You may stop using Houseticker at any time.

We may suspend or terminate your access if we reasonably believe you have violated these Terms, created a security or legal risk, abused the Service, or used it in a manner that could harm Houseticker or others.

Sections that by their nature should survive termination will continue to apply.

19. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.

Except where applicable law provides otherwise, disputes arising from these Terms or the Service will be brought in the state or federal courts located in Santa Clara County, California, and you consent to jurisdiction and venue in those courts.

20. Changes to These Terms

We may update these Terms as Houseticker develops.

When we make material changes, we will update the effective date and provide additional notice when required by law.

Your continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
